Estate Administration
Probate and estate administration in New York is the process whereby a deceased person‘s assets are managed, debts and taxes are paid, and the remaining assets are distributed to the decedent’s beneficiaries or heirs.
Probate is the process of proving that a will is valid. The court examines the will to assure it meets all legal requirements. If everything is in order, the court will appoint an executor (typically the person named in the will) to manage the estate.
If the deceased person died without a will the court will appoint an administrator to manage the estate. The administrator is responsible for gathering the deceased person’s assets, paying debts and taxes, and distributing the remaining assets to the heirs pursuant to New York intestacy laws.
In New York, probate and estate administration matters are handled by the Surrogate’s Court in each county. The Surrogate’s Court oversees the probate and estate administration process.
